WHO WILL TAKE THE COURTS TO COURT


If one travels towards the magnificent cluster of buildings that houses India’s Supreme Court One gets to hear a steady pounding of what appears to be rhythmic drums belting out a monotonous beat.
On closer scrutiny, it’s the reassuring sound of the gavel ringing out various judgments on matters put up in the myriad court rooms for their wise and varied judgments of course within the frame work that the constitution has framed.
But of late that steady, strident beat has made me apprehensive bordering on anxiety at the manner in which- judiciary-one of our second last bastion of Democracy is veering to, like the
-high courts of Punjab are laying down rules for toll collection on the Delhi Gurgaon freeway.
-One of the Supreme Court benches lays guideline to conduct Auctions of valuable spectrum.
-high court of Gujarat unilaterally directs all vehicles in state of Gujarat to be powered by CNG.
-Once again a bench of Supreme Court decides that not 74 but 374 drugs needs to be brought under price controls
- A lower court in Maharashtra slaps sedition charges on a cartoonist
-Again Supreme Court decides to Ban outright all iron mining first in state of Karnataka & then in the state of Goa, pending investigations.
- Once again the Supreme Court gets into crossing the “t”& doting the “I” and lay down how the iron ore from Karnataka should be sold and unveils a complex operating procedure on utilizing the sale proceeds.
For a person leafing thru these pronouncements in the news on a lazy Sunday afternoon this looks a case of the judicial arm steadfastly preventing subversion/subterfuge of justice by the state machinery at large which is overlooks the executive functions
Not for me, I and surely many others firmly feel that these judges are going out of their mandate, unfettered, crossing the invisible line separating judiciary and the Executive.
When we have a lax executive its sometimes needs to have some level of judicial activism to prod the executive back in line & remind them of their responsibilities
However this judicial activism has seen a bad tendency to step into policy making which is the EXCLUSIVE domain of the executive. And we very badly need the Judiciary to rein in the tendencies.
A study by duo of Sudhir krishnaswamy&Abhayraj Naik of the Law governance Development initiative at the Azim Premji University revealed that the caseload of the Supreme court (SC)is growing at much faster rate than all the high court’s & lower courts put together.
The number of cases appealed to SC.between 2005 to 2010 is to the tune of 43000, a sharp increase by 52%!
The study also narrates The Indian government Paid Rs 50 crores as compensation to an Australian based company “Whites” as ordered by the united nation commission on international law arbitration
In giving the award it said “Tribunal has no difficulty in concluding the Indian judicial system’s inability to deal with White’s jurisdictional claim in over nine years and the supreme courts ability to hear White’s jurisdictional appeal for over five years amounts to undue delay and constitute breach of India’s voluntarily assumed obligation of providing White with effective means of asserting claims and enforcing rights”
and yet and yet in spite the SC having such a huge backlog and (numbers mounting)are seen being quick to take up issues related to Public Interest Litigations (PIL).
PILs are a bane of India, with India housing the world largest Hound pack of NGO‘s,
-These NGO.s clog the systems with litigations & it’s quite bewildering as to how the NGO’s afford to fight the battles in the SC?
It’s even more bewildering that SC is quick on uptake of these litigations and quicker to pronounce a “Stay” as an interim relief!
 PIL’s are taken up by courts with passion, and a dishing out a “stay” for PIL’s are never a substitute for analysis of hard facts rather than bringing things to halt
As the incoming tide lifts all the boats, let’s not have a court which LIFT’S up most (if not all) PIL’S that reach the shores of the court

Taking the particular case of outright Ban on iron ore mining, the SC vision is myopic in nature and catastrophic in consequences.
The macro micro vision at altitudes where the judiciary sits in their high backed chairs is shockingly enveloped with thick- pea soup fog which Delhi is famous for.
At the macro level The Mining Ban in Karnataka has made massive steel plants run at miniscule capacities (sometimes below 50%) The resulting lowering of production has increased Steel Imports
Plants put up with high Debt components are seeing faltering of interest payments to Banks
Therein, spreading their sickness to other sector of economy.
Taxes collections both direct& indirect take a hit. Steel Imports mean foreign exchange outgo, aggravating CURRENT ACCOUNT Deficit.
Ban on mining, also led to halt of Exports again resulting in drying up Export Duties to tune of 1000’s of crores, again aggravating CURRENT ACCOUNT Deficit.
The ore which gets exported to steel plants overseas have to face sudden drying up of raw materials, which in turn gave the nation a big hit with respect to credibility as reliable source in the world market….
The effects are manifold than this space can do justice to.
At the micro level there is a big hit to the unsuspecting local populace - numbering in lakhs- by a judicial drone attack from the Supreme Court on an action initiated by a PIL.
This sizeable population suddenly find themselves unemployed without any means of sustenance, with idling assets.
If there is a need, to clean up the Mining Industry, the path to follow should not be at the expense of economic and Industrial health of the nation & certainly not at putting common man on the streets, with his livelihood snatched
While the courts & the attendant legal luminaries go into technicalities the larger picture of courts of land duty bound to initiate dispensing justice is given the go bye, making us wonder
Whether the motto “whence Dharma, Thence victory” is serving which Dharma and thence Victory for whom?
As in case of the mining Ban whether Dharma is to have the man on the street gainfully employed for his sustenance or victory for someone who is a serial “PILitigator”.
There appears to be a clear divide in the judiciary
Seated in one side of the judicial divide are distinguished old school judges who have a distinctive socialistic (read anti capitalist) frame of mind, whose judicial DNA cannot come to term with spring of the entrepreneur movement post liberalization and its attendant (so perceived) problems like land use, resource use ,environment etc.
 
On the other side, equally distinguished brother judges foisted in hallowed corridors of judiciary, are living in present, and are travelling the same road this nation needs to
Well aware of realities looking thro glasses, in spirit of the law, and not the law per se
the balance is however weighed down towards the former, as can be seen in the judicial drone attacks, triggered by PIL’s 
If one looks up at the statue of lady justita, adorning many a court rooms, standing silently blindfolded, one can see her holding aloft, scale in the right hand, a correctly balanced scale depicting a balance of truth and fairness.
Most of us only look at the scale and what it depicts; one needs to lower the gaze at the grounded double edged sword in the left hand for this symbolizes the power of reason and justice as the two edges of the sword.
The sword that gets used for PIL’s, in regular intervals, is definitely does not belong to lady Justita as the swathe cuts up many an innocent without any reason or justice
 And courts seem unmindful of the collateral damage it brings about cutting short livelihood of lakhs.
 To quote S. H. Kapadia, the Former Chief Justice of India on policy making role by courts
“Not ordinarily amenable to judicial review unless the policy are contrary to statutory or constitutional provisions or arbitrary or an irrational or an abuse of power”
 Heaven is a place where the army is in the Barracks,
 The Executive is in the Parliament and
The judiciary is firmly ensconced in the 22 acre campus that houses the Supreme courts.
Remaining firmly within the Laxaman rekha of proprietary, justice and fairness for all
And refraining from, excessive JUDICIAL activism trespassing into a realm of democratically elected.
And firmly committed to, TRUTH, FAIRNESS, and REASON AND JUSTICE TO ALL.

PARITY PARADOX

India is a  country blessed with a demographic dividend that -as pundits say - will drive India into a high growth trajectory.
A good part of this dividend is found in the sylvan settings of rural India.WHICH IS many a times portrayed as the oppressed, improvised,and left to fend for themselves come what may.
This state of affairs has created a disparity in the quality of life that they enjoy vis a vis their urban counterparts.
I was rudely shocked from this rural stupor when i noticed that the tranquil village setting is a base camp for  large scale  operation" rip off."
I entirely blame myself for being so naive about the "rural rip off"
The rural rip off runs like with a striking regularity.in the way the rip offs  usually go on .
This  starts with Indian festivals cycle of holi- Ganesha chaturti - Diwali & Christmas,and few village fairs & games sponsorship 
thrown in.   
The village folks get around to collect "donations" from all supposedly for celebrations but actually end up in pockets of the village busybodies who has mastered this science of rip offs into an art.
The repercussions of those who are not in the "donation" mode is swift.
 The village folk  is boycotted by fellow villagers under the advice of the village goons,for folks in business in and around have to face retribution by way of blockage of the Business activities .
All this goes on in the sylvan,tranquil  surroundings that village are construed to be.
This sham goes on with knowledge of the politicians in the upper echelons of political hierarchy,
The ethical fabric of village  is sadly, woven with strings of deceit,greed,brinkmanship& hooliganism,all this hides behind a facade of tranquility  which does not augur well for India in the years to come.
the blatant mannerism exhibited espouses that there is no tomorrow
and conveys "Eat ,Drink & merry for tomorrow we die"
The day is not far that the life of rip offs will end & bring these village folks out on the streets for having milked the Cow to point of no return.
I hope i am proved wrong & indian villagers get down working & make a village what it project to be
-- a tranquil settings where the demographic dividend really waits to be reaped for a rich strong resilient & a vibrant India.

MINEFIELD OF POLITICS

The word/s MINE/MINING instantly creates an image of devastation,degradation, deprivation,decimation & will need umpteen more no of adjectives of the English language.
We have today a world looking at the word 'Mining' with a jaundiced eye & tinge of green
This is partly right but to a very very large extent WRONG.
FOR all KNOWLEDGEABLE & Unlettered citizens it is of a primary Importance to know in a life cycle of civilization,that WHAT CANNOT BE GROWN HAS TO BE MINED.
Meaning that i can GROW Wheat on Mother Earth, but i need to MINE iron from mother Earth to make a implements to harvest the wheat into flour to get it onto the table.
We can make cars from the same iron mined but we need the crude oil to make it run.
we make furniture from trees to sit/sleep but we again need to mine iron to make nails to hold the chair together.
As we all see, its Mother Earth,that provides us all the sustenance,the ability to grow & the ability to harvest .
So, one cannot pit ONE INSTEAD OF OTHER, BUT IT'S ONE WITH ANOTHER
With a back ground of the necesacity of .having to have a marriage of convenience of mining & all other activity,we need to look at the recent imbroglio of Orissa bauxite mining project.
This project in orissa was one to mine aluminium.in a remote tribal areas,but was shot down by Environmentalist as a Ecological disaster.
Once the dust settles,its apparent that
- the project was shelved as it would bring in tribal s in mainstream thro rehabilitation from their origin,which means you cant take them for a ride & get them to vote as per your fancies.
- the project will have brought economic development in an non congress ruled state
- The economic uplift would have been credited to the state Government,which is bad for - Congress as it shows opposition party in a good light fr the local populace
- The increased revenue for the state translates into increased development of the state
that too a NON congress state.
- The tribal empowerment would be like taking away the trump card of the Live-in Crown prince,a young 40ish Rahul Gandhi; A baby in politics.
- the project initially OKd was suddenly done away with as it dawned on them that a certian industrial group ie Vedanta will be having a respectable share of the Aluminium ore vis a vis others.
if u look at things we now know- that on Mother Earth besides land to grow wheat,besides ore to use for mankind's benefit there also are species called politicsapiens,who are there to remind us that besides roses in life there are nasty thorns ,who make people life miserable more miserable that what mining purports to do.

ROYAL LOOT

After all the hoopla of THE Commonwealth Games& the attendant scam India has now settled into their favorite sofa to watch a magnum opus called the ROYAL LOOT a.k.a
Raja's Loot.
It is now in public domain as to how a person assisted by crooked bureaucrats defraud India of 174000 crores of potential income, which would have been in the kitty, with an Auction of 2G Spectrum, but fr the gang of 4 ably led by the King.
It is a matter of interest to us all to see the king in the dungeon fr acting against the state of India.
The logical end fr the LOOT ,fr all Indians will love to see Raja convicted & later to be found out on streets resting below a telecom tower unable to pay his cell phone bill, ask fr alms.
It also would do wonderful if all telecom Co's are made to cough up the deemed value that is due to Indians.
Sadly my earlier post of TELECON & not TELECOM is going undisputed.lets all catch these people by their neck & shake down all the loot which they have pocketed.

Telecon in India

Yes you read it right its Tele con (as in conning a person) in a mad scramble fr spectrum band width the telecom companies show ghost activations to corner bandwidth.in the wake it leaves behind & ploughs thro layers of genuineness,ethics & fact to show bloated activations, all in the name of getting additional spectrum allocations.
This subterfuge is ably assisted by breed of self centered, "CV " centric employees mostly from hallowed halls of prestigious & not so hallowed halls of management institutions- you r right bright & dynamic MBAs.
What is the way forward? Govt can well verify the genuineness by checking the data on recharge done for a activation (other than initial recharge) . within a week if no sustained usage is shown by decrement of recharge the activation can be marked as FAKE !
there is a way forward to this if the fight for genuineness is taken to the doorstep of the Telecom companies & put a end from being a TELE CON co

Can of worms 2

The telecoms boom in India is a much heralded & well documented all over the world & is touted to be the largest thing after the big bang.!
if one has to go just a little deep into the matter, a question pops in the mind is this for real?
Partly it is but partly it is not!. there are large scale incidents of ghost customers by activating Sim cards just to ramp up nos to show additions to customer base.
this reprehensible practice is very sadly being done by many including Cos who are touted to be ETHICALBUSINESS houses.
This ,to best of my knowledge goes unreported.in the media the reasons may be varied, one main reason could be the media is scared of disrupting their revenue streams frm ad which the telecom cos have to offer in event of reporting this scam.
this entrapment also works to bring keep the trade mum on the topic as they also rake in the moolah.so apparently this combine of teleco co,trader &silent govt work towards a win win situation.
the spanner in the wheel are ethical disributors { an entity who is the go between the co & the trade}who are sidelined if they do not fall in line to this ghost activations.
if somebody from the media happen to read this & can be brave & selfless to dig into this with an expose.
it can be indias telecomgate.

can of worms

we are witnessing, a boom in telecoms,so they say.
i always wonder if someone goes up those magnificent tower & pop ones head to listen to the
all the yakety yack,that goes on in the air,there is a good chance that one will be hearing a deafening silence. a silence which in conspicuous by its presence in a place like that.
well the reason may be something which we always have to wonder.
